ARRIVE ALIVE GUARANTEE
To see your tree is alive, scratch a small area of the bark on the trunk of your plant a few inches above the root system. If below the bark is brown or black, your tree is not alive. If below the bark is green, white, or moist your tree is still alive. Tree wilting is a normal process when during shipment. They need watered every day for the first few days after planting. By doing this, your tree will come back out the following spring and do well. We dig all our plants fresh and ship the same day. So, we don't worry about the condition but you can always check by doing the above method.
CANCELLATIONS:
We accept no cancellations on orders. They are dug within 24 hours or sooner after order receival.
RETURNS:
We accept no returns. All returned stock without written authorization will be discarded and not accepted as refund or replacement materials.
Call Within 24 Hours Of Receival If There's a Problem
If you receive a shipment and there is a valid problem, call us within 24 hours of receival. Failure to call and report any problem within 24 hours will result in a non consideration of your claim.
Live Plant Wholesale Procedure
All plants are sold “as is” without warranty, express or implied, as to quality, variety, description, productiveness, merchantability or results secured in planting. We will ask for photos and a written letter from your local USDA extension agent after plants are inspected. We do not ship anything but fresh harvested plants. We are wholesale and we can not offer you a refund or replacements on a tree or plant after it has been planted. All Sales are Final.
CONTINGENCIES:
We reserve the right to prorate or cancel any order, in whole or in part, because of: strikes, labor shortages, fire, frost, flood, drought, disease, casualty, errors in count, spoilage, or other circumstances beyond our control.
SUBSTITUTIONS:
We do reserve the right to substitute a plant of similiar species and value when we are soldout of the particular species ordered or we see that product will not be hardy for your zip code hariness zone, unless customer places in comments section of order form they will not accept substitutions.
TRANSIT DAMAGE:
We are not responsible for plants after they leave our facility. However if you want your plants insured, please specify this when ordering in comments section and your trees will be insured. Otherwise it's the customer's responsibility to handle any packages damaged in transit.
HOW WE PROTECT PLANTS FOR TRANSIT:
Plants are packaged to survive 10 days in transit. We use the American Nurseryman's
ethics in packing and shipping. All plants are dug fresh, dipped in terasorb and peat moss then wrapped in plastic before putting in corogated shipping boxes.
CUSTOMER MUST AGREE TO OUR TERMS PRIOR TO PLACING AN ORDER:
When you go online and place an order, you are agreeing to our terms. Please do not call us and ask or expect us to bend or break our rules. They were made to protect us and to let you know you can do a self test upon receival of our product to prove you receive alive, healthy plants. Beyond this, we offer no guarantees.
WHOLESALE NURSERY TERMS OF POLICY:
We are not a retail nursery. Most retail nurseries prices their stock triple our price of a wholesale grower, meaning you pay for replacements upfront. At TN Nursery, our prices are at a "bare bones" minimum wholesale price. We will not go beyond this policy.
We do ask that you refer to this policy prior to calling us. You will be informed of this policy and we do follow strict guidelines in keeping this policy enforced without any favor or leniency.
Legal - Jurisdiction
Any litigaton claims, jurisdiction claims or attempts must be held and filed in the courts of Grundy County Tennessee.
